This Personal Data Privacy Policy (PPD) is regulated by the General Data Protection Law (Law No. 13.709, of August 14, 2018), effective in Brazil since September 2020, hereafter referred to as LGPD.

We are a company that specializes in physical organization, management, storage, digitization, and secure disposal of documents, operating in the market since 1999.

We refer to Wams using terms such as “site,” “we,” “our,” “with us,” “company.”

We refer to our users, customers, consumers, and data subjects using words like “you,” “your,” “client,” and similar expressions.

By visiting, browsing, and enjoying the site, you automatically accept the conditions described below, which make up the Privacy and Data Protection Policy, as well as become aware of our policy related to the use of cookies for which you may manage your consent.

Important Concepts:

Personal data are information that identifies or can identify individuals and, for this reason, they are part of the data subject’s privacy.

Under the terms of the LGPD, the individual owner of personal data is qualified as a Data Subject, and Wams as a Personal Data Processing Agent, which can be either a controller or operator.

In the case of information provided on the site, Wams will be the Controller of personal data, as it is the agent responsible for the decisions about the treatment.

Important: You are not obligated to provide information to our site. You can revoke your consent or unsubscribe at any time you wish, by sending this request in writing to one of our communication channels, indicated below.

However, without providing certain information when requested, you will not be able to access some functionalities, such as registering on the site to request a quote, send a message, or submit resumes.

We collect information to provide or offer better services to all our users, and it occurs in the following way:

1. Collection of Personal Information

The Wams website may collect personally identifiable information such as name, surname, email, phone number, cell phone provided directly by the user/data subject through the “Contact Us” form, by which you can send a message, which will be sent from your email to ours: https://wams.com.br/contact-us/

You can send an email directly from your email to Wams‘ email, accessible on the same site, under the “Contact” tab: https://wams.com.br/contact-us/, through which we will have access to your email address and the requested data from the form, such as name and phone.

On our homepage, there is a restricted access area intended only for client users previously identified and registered with a non-transferable personal access password, as well as company employees.

Users can navigate through the sites and channels above without providing this information, but to request information, send messages, they must provide it to complete access.

Such data may be stored by the company in a CRM system, which also guarantees the protection of personal data, for the purpose of marketing actions or sending information of interest to the user.

Thus, by filling in such information on the respective forms, the user expressly consents to receive messages, emails, calls from the company, and receive files with presentations of products and/or services, and may unsubscribe at any time.

2. Use of Your Personal Information

Whenever you access and use our site, Wams will automatically receive and store information, including your IP address, cookie information, which will be related to the personal information you provide.

Wams will make your personal information available, without prior notice, only in the event of: (a) applicable legislation, regulation, legal process, or government request; (b) compliance with an investigation of possible violations; (c) prevention of fraud or for security or (d) protection of the rights of the company, users, or the public, as requested or permitted by law.

Wams will register the user, keeping in its system the specific records of Transactions made.

All documents and information related to the data subject’s registration will remain secure in the possession of Wams.

The Data Subject is aware and authorizes Wams to share the above information with its employees, who have been trained on personal data protection, being constantly monitored, as well as with third parties such as marketing consultants, who are prohibited from sharing their data with third parties.

We will use the information sent (a) to respond to a specific request; (b) with your consent, to send additional materials related to the company and services that may be of interest to you; (c) send responses to inquiries or requests for quotes for contracting services.

Wams is a private company and, as such, reserves the right at its sole discretion and according to its parameters, analysis to accept or not the adhesion of the data subject.

Regarding requests for quotes or information made by WhatsApp and email, we do not keep copies of personal documents, such as ID and CPF stored whether in the messaging application, email server, or physical file. When receiving information from users through these channels, as informed above, we use them at the user’s request to comply with legal obligations or contract negotiations and, after, we delete them. Data such as name, email address, phone number, address are stored in CRM and can be used for marketing purposes and sending information, with which the customer has the right to disagree and/or revoke at any time.

Wams reserves the right to block, cancel or delete data sent by users, due to the existence of indications or actual illicit identified, with the aim of preventing fraud, as well as for credit protection.

3. Legal Bases

The General Data Protection Law allows the processing of personal data that identify or may identify natural persons in 10 situations, provided by law.

On its site, Wams processes data, using the legal permissions below informed:

3.1. Consent of the data subject, in cases where the data subject agrees to a certain activity with their personal data, filling out forms for us to contact, sending offers, news, promotions, as the purposes indicated in this Policy;

3.2. Compliance with legal or regulatory obligation by the controller, in cases where the law requires the processing of data such as, for example, sending data to public bodies for the issuance of Invoices.

3.3. Execution of a contract or preliminary procedures related to a contract of which the data subject is a party, at the request of the customer, in cases where the site or other channels sell a service that will be made available to the user, it being necessary to store transaction data and registration data, in order to enable the sending of quotes or fulfillment of the contract;

3.4. Legitimate interest of the controller, in cases where the sending of targeted marketing is carried out, with the requirements of the LGPD being observed;

3.5. Regular exercise of rights in judicial, administrative, or arbitration proceedings;

3.6. Credit protection.

4. Sharing Information with Third Parties

Wams will not pass, rent, or sell your email address, phone, CPF, or other personal data. We will not share your personal information with other companies, except with your express authorization or for the purpose of fulfilling our contract or, further, in case of a judicial order or legal requirement.

We will share information with our service providers, hired consultants, employees for the purpose of providing requested information, sending quotes, or fulfilling a contract with our customers, as well as in the case that the user expressly agrees to receive information, offers, and promotions.

These third parties will be instructed and trained to follow our Data Privacy Policy or we will require them to follow policies that guarantee the same conditions of protection as this one.

We are not responsible for the way third parties not linked to the company collect, use, protect, or disclose information.

5. Age Restriction

The Wams site is designed for users of legal age. If you are under 18 years of age, you will not be allowed to send your personal information to our site.

Thus, to make registrations, request quotes or information, you declare that you are over 18 years old and must inform your date of birth.

If we become aware that minors are sending personal data through our environments, we will inform the user and delete all data.

6. Collection of Sensitive Data

On the Wams site, we do not collect or retain sensitive personal data related to your health, ethnic origin, religious beliefs, sexual orientation, or political conviction etc.

Information, messages, or resumes that contain data considered sensitive will be immediately deleted.

7. Security

Wams has security measures in physical, electronic, and administrative scopes, which protect personal data and your information. These protection measures help us in preventing fraud and unauthorized access to information, as well as in maintaining the integrity of the data. The Wams site is a secure environment for browsing, which can be verified by the security lock next to the electronic address.

All Personal Data will be stored in a database maintained in a CRM system by a service provider contracted by the company, which is duly in accordance with the General Data Protection Law, under penalty of discontinuation of services.

Wams, its suppliers, and employees use security procedures to protect the confidentiality, security, and integrity of your Personal Data, preventing the occurrence of possible damage due to the processing of this data.

All our devices and applications have up-to-date antivirus and regular computer programs, as well as secure personal passwords for access to information.

Although the company uses security measures and monitors its site to check for vulnerabilities and attacks to protect your Personal Data against unauthorized disclosure, misuse or alteration, the user understands and agrees that there are no guarantees that the information will not be accessed, disclosed, altered or destroyed by breach of any of the physical, technical, or administrative protections.

In the event of any incident, we will take action as soon as we have knowledge and will collaborate to minimize any damage, whether with the Data Subjects or with the competent authorities.

8. User Rights

Access. The user may request information regarding which data are stored and for what purpose.

Rectification. The user may request the correction/update of any of their personal data, as it is their responsibility to keep them always up to date.

Deletion. The user may request the deletion of their personal data in the following situations: (i) when they are no longer necessary for the purpose for which they are used, (ii) when they no longer consent to the terms set forth herein.

Other rights of users of the site in relation to their personal data, guaranteed by Wams, in compliance with the LGPD:

  • confirmation of the existence of treatment;
  • access to data;
  • correction of incomplete, inaccurate, or outdated data;
  • anonymization, blocking, or deletion of unnecessary, excessive data or data processed in non-compliance;
  • portability of their data to another service provider or product, upon express request by the data subject;
  • deletion of data processed with the consent of the data subject;
  • obtaining information about public or private entities with which Wams has shared their data;
  • information about the possibility of not providing your consent, as well as being informed about the consequences, in case of denial; and revocation of consent.

9. Changes to This Statement

In case of modification of these terms, to better serve our customers and users, we will publish such changes to the privacy policy and notify you about this situation.

We will keep previous versions of this Privacy Policy archived for you to compare.

10. Data Retention Period

For users who have sent a message or registered in the available channels, we will keep the data stored for 180 days and, after that, they will be deleted from our database or until any request for deletion by the data subject, whichever occurs first, which can be done through the privacy channels indicated in this Policy.

11. Consent

The user of this site and our access channels, by filling out the forms to send messages or requests for quotes, are consenting to the access to their personal data indicated above for the purpose of registration and contact and receiving messages by email, SMS, WhatsApp with news about the company, information about services, product offers, and promotions.

At any time, the user can revoke their consent totally or partially, which can be done in some of the channels below upon specific request or in links that will be sent along with the messages.

12. Data Officer (Data Protection Law)

During the period of storage by Wams, there will be an exclusive person responsible for the data, under the terms of art. 41 of the Data Protection Law. This person will respond for the data, in case there is a need to present them to the competent authority as well as provide information about your questions, upon request for this purpose.

13. Mediation, Applicable Law, and Court of Choice

This policy is subject to the Law of the Federative Republic of Brazil and the Court of the District of Campinas – SP is competent to resolve any controversy between the parties.

In case of an incident with Personal Data, Wams, from now on, reserves the right to submit the case to the CEJUSC (Judicial Conflict Resolution Center) of the Judiciary City of Campinas, São Paulo to resolve the issues involving the data subject users, under the terms of article 52, §7º of the General Data Protection Law.
